General Terms and Conditions
The following terms apply to all contracts, services and offers of CityFreight, a brand of Logisticoo GmbH (hereinafter "CityFreight").
1. Scope
These General Terms and Conditions apply towards entrepreneurs within the meaning of § 14 BGB. Our services are governed – insofar as legally permissible – by the German Freight Forwarders' Standard Terms and Conditions 2017 (ADSp 2017). For cross-border carriage of goods by road, the mandatory provisions of the Convention on the Contract for the International Carriage of Goods by Road (CMR) apply with priority.
2. Offer and conclusion of contract
Our offers are subject to change. A contract is concluded through our written order confirmation or through the execution of the transport. The respective order confirmation is decisive for the scope and content of the service.
3. Scope of services
CityFreight provides direct and part-load transport as well as express and customs clearance services in European road freight transport. The specific scope of services results from the individual order.
4. Obligations of the client
The client is obliged to provide complete and correct information on the nature, condition, weight, dimensions and value of the goods as well as on any special requirements. Dangerous goods (hazardous goods under the ADR) must be announced separately and in good time; for ADR-regulated transport we refer you to our sister brand Gefahrgut Express.
5. Prices and payment
The prices stated in the offer or in the order confirmation apply, plus statutory VAT. Unless otherwise agreed, invoices are due within 14 days without deduction.
6. Liability
The liability of CityFreight is governed by the ADSp 2017 as well as the mandatory statutory provisions, in particular the CMR for cross-border road transport (maximum liability amount generally 8.33 Special Drawing Rights per kilogram of gross weight). Any further liability is excluded, unless intent or gross negligence is present or mandatory statutory provisions apply.
7. Insurance
Transport or goods insurance going beyond the statutory or ADSp liability is only taken out upon express request and for the account of the client.
8. Applicable law and place of jurisdiction
The law of the Federal Republic of Germany applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is, insofar as legally permissible, Berlin.
9. Severability clause
Should individual provisions of these Terms and Conditions be invalid, the validity of the remaining provisions remains unaffected.
